A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURIEN AMENDING RESOLUTION NO. 115 ADDING SECTION 14 PROCEDURE FOR RESPONDING TO A VIOLATION OF THE CODE OF ETHICS AND SECTION 15, REMEDIES

            WHEREAS, the City Council wishes to establish a procedure for determining violations by its members of the City of Burien Code of Ethics and or Council Policies and Procedures; and

 

            WHEREAS, the City Council wishes to establish options for responding to a violation of the Code of Ethics or Council Policies and Procedures.

 

            NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, DOES RESOLVE AS FOLLOWS:

 

            Section 1.  Section 14. Procedure for Determining Code of Ethics Violations is hereby added to the City of Burien Code of Ethics Resolution No. 115 as follows:

            a.         Alleged violation complaints will be referred to the Mayor in private.  If the Mayor is the individual whose actions are being challenged, then the matter should be referred to the Deputy Mayor.

            b.         The Mayor may ask the City Manager to assist the City Council by providing a list of qualified experts to investigate the alleged violation.

            c.         The City Council by majority consensus of the whole council will select an independent third party from the list to conduct the investigation and provide an objective determination. 

 

            Section 2Section 15. Violation of the Code of Ethics. Remedies is hereby added to the City of Burien Code of Ethics, Resolution No. 115.  In the event the council determines the individual against who the complaint was made has violated the code, then the city council may take any or all of the following actions by a vote of five members of the whole council: (a.) discuss and counsel the individual on the violation, (b). give nonpublic admonition, (b). reprimand or (c). censure by Council resolution.

 

Section 3.  Section 16.  Section 14 of Resolution No. 115 is hereby renamed to Section 16. 

 

Section 4. Effective Date. This resolution shall take effect immediately upon passage by the Burien City Council.

 

 

            ADOPTED BY THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, AT A REGULAR MEETING THEREOF THIS 6TH DAY OF JUNE, 2005.
