RESOLUTION NO. 216

 

A RESOLUTION OF THE CITY OF BURIEN, WASHINGTON, AUTHORIZING APPLICATION FOR FEDERAL FUNDING ASSISTANCE FOR A LAND AND WATER CONSERVATION FUND (LWCF) PROGRAM PROJECT TO THE INTERAGENCY COMMITTEE FOR OUTDOOR RECREATION (IAC) AS PROVIDED IN THE LWFC ACT OF 1965, AS AMENDED.

 

            WHEREAS, the City of Burien has approved a comprehensive plan that includes this project area; and

 

            WHEREAS, under the provision of LWCF, federal funding assistance is requested to aid in financing the cost of land acquisition and facility development; and

 

            WHEREAS, the City of Burien considers it in the best public interest to complete the land acquisition and/or development project described in the application.

 

            NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, DOES RESOLVE that:

 

            Section 1.  The Parks, Recreation and Cultural Services Director be authorized to make formal application to IAC for funding assistance;

 

            Section 2.  Any fund assistance received be used for implementation of the Seahurst Park Upland Rehabilitation Project;

 

            Section 3.  The City of Burien hereby certifies that its share of project funding will be derived from City funds and other grant sources;

 

            Section 4.  We acknowledge that we are responsible for supporting all non-cash commitments to the sponsor share should they not materialize;

 

            Section 5.  We acknowledge that any property acquired or facility developed with IAC financial aid must be placed in use as an outdoor recreation facility and be retained in such use in perpetuity unless otherwise provided and agreed to by the City of Burien, IAC, and the National Park Service;

 

            Section 6.  This resolution becomes part of a formal application to IAC; and

 

            Section 7.  We provided appropriate opportunity for public comment on this application;

 

Section 8.  We acknowledge that LWCF grants are federal funds and, as such, the City of Burien must comply with all applicable federal laws.

 

 

            ADOPTED BY THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, AT A REGULAR MEETING THEREOF THIS 6th DAY OF JUNE, 2005.
