RESOLUTION NO. 209

 

A RESOLUTION OF THE CITY OF BURIEN RELATING TO THE SCHEDULE FOR COMPLETION OF THE REQUIRED GROWTH MANAGEMENT ACT UPDATE

 

            WHEREAS, the City of Burien is required to plan under RCW 36.70A.040.

 

            WHEREAS, every seven years, RCW 36.70A.130(1) requires the City of Burien to take legislative action to review and, if needed, revise its comprehensive plan and development regulations, including its policies and regulations designating and protecting critical areas to comply with the requirements in Chapter 36.70A RCW.

 

            WHEREAS, under the schedule established in RCW 36.70A.130(4), the deadline for the City of Burien to comply with the update required by RCW 36.70A.130(1) is December 1, 2004.

 

            WHEREAS, on October 20, 2003, the Burien City Council adopted Ordinance 394 establishing regulations designating and protecting critical areas to comply with the requirements in Chapter 36.70A RCW and meeting its update requirement under RCW 36.70A.130(1).

 

            WHEREAS, on December 15, 2003, the Burien City Council adopted Ordinance 397 revising its comprehensive plan to comply with the requirements in Chapter 36.70A RCW, meeting its update requirement under RCW 36.70A.130(1).

 

            WHEREAS, Ordinance 397 contained new transportation levels-of-service that need to be adopted as part of the city’s development regulations.

 

            WHEREAS, the City of Burien has made substantial compliance with the update requirements under RCW 36.70A.130(1), except for inclusion of the new transportation levels-of-service into BMC 18.70.

 

            NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, DOES RESOLVE AS FOLLOWS:

 

            Section 1.  Completion of Required Development Regulation Update. 

City staff is directed to prepare appropriate revisions to BMC 18.70 to conform that chapter with Ordinance 397 and the Growth Management Act, according to the following schedule:

 

·        March 2005: Planning Commission public hearing and recommendation on proposed ordinance amending BMC 18.70

·        April 11, 2005: Council public hearing and discussion on proposed ordinance amending BMC 18.70

·        April 18, 2005: Adoption of ordinance amending BMC 18.70.

 

Section 2.  Effective Date. This resolution shall take effect immediately upon passage by the Burien City Council.

 

            ADOPTED BY THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, AT A REGULAR MEETING THEREOF THIS 7TH DAY OF MARCH, 2005.
