RESOLUTION NO. 195
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, AMENDING RESOLUTION NO, 192 DECLARING THE INTENTION TO DESIGNATE A RESIDENTIAL TARGET AREA (RTA) FOR PURPOSES OF A TEN YEAR TAX ABATEMENT PROGRAM, TO ADOPT A NEW CHAPTER 19.45, URBAN CENTER DEVELOPMENT, AND TO HOLD PUBLIC HEARINGS THEREON
WHEREAS, on July 19, 2004, the City Council of the City of Burien passed Resolution No. 192 declaring the intention to establish a Residential Target Area (hereafter “RTA”) for purposes of a ten-year tax abatement program, to adopt a new Chapter 19.45 Urban Center Development, and to hold public hearings thereon before the Planning Commission and the City Council on August 10, 2004 and August 16th 2004 respectively; and
WHEREAS, the City Council of the City of Burien wishes to expand the RTA beyond the RTA described in Resolution No. 192; and
WHEREAS, the City Council must accordingly amend Resolution No. 192 to include the expanded proposed RTA in the public hearing notices required to be published pursuant to RCW 84.14.040(3); and
WHEREAS, the public hearings before the Planning Commission and the City Council must be rescheduled for August 24th 2004 and September 13, 2004, respectively, in order to meet the notice and publication requirements set forth in RCW 84.14.040(3);
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, DOES RESOLVE AS FOLLOWS:
Section 1. Amendment. Section 1 of Resolution No. 192 is hereby amended to read as follows:
Intention to Designate RTA. The City
Council of the City of Burien hereby states its intention to designate the
Downtown Commercial (DC) Zone Urban Center
as shown on Comprehensive Plan Figure 2LU-1.11 as the RTA for purposes of the ten-year tax abatement program
authorized by RCW 84.14.
Section 2. Amendment. Section 2 of Resolution No. 192 is hereby amended to read as follows:
BMC Chapter 19.45, Urban Center Development,
Proposed for Adoption. Proposed
BMC Chapter 19.45, Urban Center Development, is attached hereto and
incorporated by this reference. Proposed BMC 19.45.020(3) establishes the
Downtown Commercial (DC) zone Urban Center as shown on Comprehensive
Plan Figure 2LU-1.11 as the RTA and
establishes standards and guidelines to be used in considering applications and
making the determinations for a ten year tax exemption as required under RCW
84.14.060.
Section 3. Amendment. Section 3 of Resolution No. 192 is hereby amended to read as follows:
Public Hearing Scheduled Before Planning
Commission. The City Clerk is
directed to schedule a public hearing before the Planning Commission to be held
on August 10, 2004 August
24, 2004 beginning at 7:00 p.m. at
Burien City Hall, 415
SW 150th Street. The
City Clerk is also directed to provide notice of the public hearing as required
by RCW 84.14.040(3).
Section 4. Amendment. Section 4 of Resolution No. 192 is hereby amended to read as follows:
Public Hearing Scheduled Before the City Council. The City Clerk is directed to schedule a
public hearing before the City Council to be held on August 16, 2004, September 13, 2004 beginning at 7:00 p.m. at Burien
City Hall, 415
SW 150th Street. The
City Clerk is also directed to provide notice of the public hearing as required
by RCW 84.14.040(3).
Section 5. Effective Date. This resolution shall take effect immediately upon passage by the Burien City Council.
