RESOLUTION NO. 192
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, DECLARING ITS INTENTION TO DESIGNATE A RESIDENTIAL TARGET AREA (RTA) FOR PURPOSES OF A TEN YEAR TAX ABATEMENT PROGRAM, TO ADOPT A NEW CHAPTER 19.45, URBAN CENTER DEVELOPMENT, AND TO HOLD A PUBLIC HEARING THEREON BEFORE THE PLANNING COMMISSION ON AUGUST 10, 2004 AND BEFORE THE CITY COUNCIL ON AUGUST 16, 2004
WHEREAS, RCW 84.14 authorizes municipalities to establish “Residential Target Areas” (hereafter “RTAs”) for purposes of allowing exemptions to ad valorem property taxes on certain qualifying new construction and housing rehabilitation for a period of ten years; and
WHEREAS, RCW 84.14.040(2) authorizes the City to adopt a resolution of intention designating the proposed RTA and scheduling a public hearing thereon;
WHEREAS, RCW 84.14.040(3) requires the City to give notice of the hearing by publication of notice once each week for two consecutive weeks, not less than seven days, nor more than thirty days before the date of the hearing in the City’s newspaper; the notice must state the time, date, place and purpose of the hearing and generally identify the area proposed to be designated by the RTA;
WHEREAS, the City Council desires to hold public hearings on the proposed RTA and proposed BMC Chapter 19.45 before the Planning Commission and before the City Council; and
WHEREAS, attached hereto is proposed BMC Chapter 19.45, which designates the RTA and establishes standards and guidelines to be utilized in considering applications and making the determinations required under RCW 84.14.060;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF

Section 2. BMC Chapter 19.45, Urban Center Development, Proposed for Adoption. Proposed BMC Chapter 19.45, Urban Center Development, is attached hereto and incorporated by this reference. Proposed BMC 19.45.020(3) establishes the Downtown Commercial (DC) zone as the RTA and establishes standards and guidelines to be used in considering applications and making the determinations for a ten year tax exemption as required under RCW 84.14.060.
