ORDINANCE NO. 485
AN ORDINANCE OF THE CITY OF BURIEN, WASHINGTON, CREATING A NEW CHAPTER UNDER TITLE 3 OF THE BURIEN MUNICIPAL CODE; ESTABLISHING A BIENNIAL BUDGET BEGINNING JANUARY 1, 2009; PROVIDING FOR A MID-BIENNIAL REVIEW AND MODIFICATION OF BUDGET, IN ACCORDANCE WITH RCW CHAPTER 35A.34; PROVIDING FOR AN EFFECTIVE DATE, AND PROVIDING FOR SEVERABILITY.
WHEREAS, by Chapter 35A.34, RCW, the State Legislature has provided that legislative body of any code city may by ordinance elect to have a two-year fiscal biennium budget in lieu of the annual budget which is otherwise provided for; and
WHEREAS, Chapter 35A.34.040, RCW provides that such ordinance must be adopted not later than June 30, 2008 in order to be effective January 1, 2009; now, therefore
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURIEN, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Establishment of Two-Year Biennium Budget. A new Chapter is added to Title 3 of the Burien Municipal Code to be known and referred to as Chapter 3.04 Biennial Budget, consisting of two sections, to read as follows:
3.04.010. Biennial Budget Established.
Pursuant to Chapter 35A.34.040 RCW, the City Council hereby establishes a two-year biennium budget, for the City of Burien, beginning with the two-year biennium which begins January 1, 2009. The 2009-2010 Biennial Budget and all subsequent budgets shall be prepared, considered and adopted under the provisions of this ordinance and Chapter 35A.34 RCW which is hereby adopted by reference as though fully set forth herein.
[A1][A2]3.04.020. [A3] Mid-Biennial Review and Modification.
Pursuant to Chapter 35A.34.130, RCW, the City Council hereby provides for a mid-biennial review and modification of the biennial budget. No sooner than eight (8) months after the start of the first year of the fiscal biennium, nor later than the first regularly scheduled City Council meeting in November of the first year of each biennial budget, the City Manager shall prepare proposed budget modifications to be effective as of January 1 of the following year. Such proposed modifications shall be sent to City Council members and shall be a public record and available to the public. A public hearing shall be advertised at least once and shall be held at a City Council meeting no later than the second Tuesday in December and may be continued from time to time. At such hearing or thereafter, Council may consider a proposed ordinance to carry out such modifications, which such ordinance shall be subject to other provisions of Chapter 35A.34, RCW. Copies of the proposed mid-biennial modification shall be made available to the public through the City Clerk. The Clerk shall transmit a complete copy of the budget modification as adopted to the State Auditor.
Section 2. Severability. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances.
Section 3. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed.
Section 4. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication, as provided by law.
